1. General
These Terms & Conditions apply to dental laboratory products and services provided by CommonHealth Dental Group Pty Ltd ("we", "us", "our"), trading as CommonHealth Dental.
By placing an order, dental professionals agree to these terms to the extent they are incorporated into the relevant agreement.
2. Dental Laboratory Orders
All orders are processed based on the prescriptions, impressions, digital scans (including STL files), photographs and instructions provided by the treating dental professional.
Dental professionals are responsible for clinical diagnosis, treatment planning, patient consent and the accuracy and completeness of the clinical information they provide.
We reserve the right to request clarification or decline an order where information is insufficient or unsuitable.
3. Manufacturing and Delivery
We endeavour to complete laboratory work within agreed or estimated timeframes.
Turnaround and delivery times may vary depending on case complexity, material availability, workload, shipping conditions and other circumstances.
Estimated completion and delivery dates are not guaranteed unless expressly agreed otherwise.
We will take reasonable steps to communicate material delays.
4. Remakes, Adjustments and Refunds
Requests for remakes, adjustments, repairs, credits or refunds will be assessed on a case-by-case basis, considering the circumstances of each case, the original prescription, materials supplied, clinical information and applicable legal requirements.
Additional charges may apply depending on the nature and cause of the issue.
Where reasonably practicable, proposed additional charges will be communicated to the dental practice before further work proceeds.
Nothing in these terms limits any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.
5. Pricing, Payments and Cancellations
Prices may vary depending on the product, materials, design requirements and complexity of the work.
Additional charges may apply for modifications, urgent requests or changes to original instructions.
Order cancellations and associated charges will be assessed according to the stage of production, work already completed, materials committed and applicable legal requirements.
Payment terms will be specified on invoices or otherwise agreed with the dental practice.
6. Clinical Responsibility
CommonHealth Dental operates as a dental laboratory and does not undertake responsibility for clinical diagnosis, treatment decisions or patient care.
The treating dental professional remains responsible for determining the clinical suitability, fitting and appropriate use of dental prostheses and appliances.
We remain responsible for the quality of our laboratory work and for obligations imposed by applicable law.
7. Limitation of Liability
To the extent permitted by law, our liability will be determined having regard to the nature of the relevant product or service, the circumstances of the claim and any applicable contractual or statutory obligations.
We are not responsible for loss or damage to the extent caused by inaccurate clinical instructions, unsuitable impressions or scans, unauthorised modifications or improper handling outside our control.
Nothing in these terms excludes, restricts or modifies any rights, guarantees or remedies that cannot lawfully be excluded under Australian law.
8. Privacy and Confidentiality
We handle personal and patient-related information in accordance with applicable privacy laws and our Privacy Policy.
Dental professionals must ensure that patient information submitted to us is disclosed lawfully and is reasonably necessary for the requested laboratory work.
9. Changes to These Terms
We may update these Terms & Conditions from time to time.
The latest version will be published on our website. Changes will not retrospectively alter existing agreements without an appropriate legal basis.
